These Terms of Service ("Terms") govern your access to and use of www.ravellowatches.com (the "Site") and any purchase you make from Ravello ("we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old to make a purchase on the Site. By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract under the laws of your country or state of residence.
2. Products and availability
We make reasonable efforts to display our products accurately, but we cannot guarantee that colors, materials, or details shown on your screen will exactly match the physical product. Slight variations are normal.
All products are subject to availability. We reserve the right to limit quantities, refuse orders, or discontinue products at any time.
3. Pricing and payment
Prices are displayed in U.S. dollars (USD) and may change without notice. We reserve the right to correct pricing errors at any time, including after an order has been placed. In the event of a pricing error, we will contact you before processing the order.
Payment must be received before an order is fulfilled. We accept the payment methods displayed at checkout. By submitting payment, you authorize the charge.
4. Orders
When you place an order, you will receive an order confirmation by email. This confirmation acknowledges that we have received your order, but does not constitute acceptance — your order is only accepted when we dispatch it.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, ineligible delivery addresses, or product unavailability.
5. Shipping and returns
Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Both policies are incorporated into these Terms by reference.
6. Intellectual property
All content on the Site — including text, photographs, designs, logos, graphics, and the Ravello name and brand — is the property of Ravello or its licensors and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.
7. User-generated content
If you submit photos, reviews, comments, or any other content to us — including by tagging us on social media (for example with #ravello, @ravello.watches, or similar tags) — you grant Ravello a worldwide, royalty-free, perpetual, non-exclusive license to use, display, reproduce, and adapt that content for marketing and promotional purposes, including on our Site, our social media channels, and our advertising materials, with appropriate credit where reasonably possible.
You represent that you own or have all necessary rights to the content you submit, and that it does not infringe any third party's rights.
You may request removal of your content from our marketing materials at any time by emailing info@ravellowatches.com.
8. Prohibited uses
You agree not to use the Site to:
- Violate any law or regulation
- Infringe the intellectual property or other rights of any person
- Transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to the Site or its systems
- Use automated tools to scrape, copy, or harvest content
- Harass, abuse, or harm any other person
- Submit false or misleading information
We reserve the right to terminate your access to the Site for any violation of these Terms.
9. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
This disclaimer does not affect any rights you may have under applicable consumer protection laws that cannot be waived or limited, including consumer guarantees under the laws of the United Kingdom, Australia, New Zealand, Canada, and the United States.
10. Limitation of liability
To the maximum extent permitted by applicable law, Ravello, its founder, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost data, or business interruption — arising from or related to your use of the Site or any product purchased from us.
Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you actually paid for the product giving rise to the claim.
This limitation does not affect any rights you may have under applicable consumer protection laws that cannot be waived or limited.
11. Indemnification
You agree to indemnify and hold harmless Ravello and its founder from any claim, loss, or expense arising from your violation of these Terms or any third-party rights.
12. Dispute resolution and arbitration
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising from or related to these Terms, the Site, or any product purchased from Ravello shall be resolved through final and binding individual arbitration, rather than in court, except where prohibited by applicable law.
You waive any right to participate in a class action, class arbitration, or representative proceeding.
This arbitration clause does not apply to the extent that mandatory arbitration of consumer disputes is prohibited or restricted by the consumer protection laws of your country or state of residence. In such cases, the dispute will be resolved before the competent courts of your jurisdiction.
13. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-law provisions. To the extent that any dispute is not subject to arbitration as set out above, the courts of the City of São Paulo, State of São Paulo, Brazil shall have exclusive jurisdiction.
Nothing in this clause limits any mandatory rights you may have as a consumer under the laws of your country or state of residence.
14. Changes to these terms
We may update these Terms from time to time. The updated version will be indicated by a new "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16. Entire agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Ravello regarding your use of the Site and any purchase made through it.
